What happens to real estate when a spouse dies and property isn’t held jointly?
Barb’s mother is living in a house that was owned by her deceased father, and remains in the name of his estate. Should the family work to change title now, or wait to deal with it upon her mom’s passing?

I doubt if Service Canada kept your Fathers original will. They usually demand to see the original to make a copy and return original to family she may have it amount her paper work.
In Newfoundland my mother-in-law passed away 25 years ago without a will. Her son lived in the house all his life with her and his wife. Recently the son passed away as well, with no will. There are still 3 living children of the parent.
Does the children have any rights to the home or does it go to the wife of her son? There are papers on the land that states the land was registered to the father and nothing was ever done to register it to anyone else.

In a similar vein, I have a question about changing the land deed…. In my case, my father and mother are named on the deed. My father passed away late in 2022. Does my mom have to change the deed now or can we wait until after she passes? Doing it later might complicate matters a bit, but as long as I keep an original death certificate for my dads passing, we shouldn’t have any significant issues later, right? They don’t have a mortgage on the house. If you could let me know or point me to some legislation, that would be appreciated…
